Résumé Omnilex

The appellant challenged a cantonal criminal decision before the Federal Supreme Court but addressed only his alleged current unfitness to serve a four-month prison sentence. He did not explain why the cantonal court's refusal to restore the appeal deadline violated federal law. The Court held that the fitness-to-serve issue was outside the scope of the proceedings and that the appeal was insufficiently reasoned. The appeal was therefore not entered into under Art. 108 BGG. In view of the circumstances, no court costs were imposed.

Regeste Omnilex

Art. 95, 108 BGG; an appeal must engage with the decisive reasoning of the challenged judgment and substantiate, in a manner sufficient for review, in what respect that decision violates federal law. Arguments directed only at matters outside the scope of the cantonal decision are irrelevant and cannot cure a deficiency in reasoning. Where the appeal manifestly fails to meet these requirements, the court may decide by summary procedure under Art. 108 BGG and decline to enter into the matter. Cost exemption may exceptionally be granted in the presence of special circumstances.

Urteil vom 20. September 2011
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Einzelrichter,
Gerichtsschreiberin Arquint Hill.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Oberstaatsanwaltschaft des Kantons Aargau, Frey-Herosé-Strasse 12, Wielandhaus, 5001 Aarau,
Beschwerdegegnerin.

Gegenstand

Question juridique clé

Whether the appeal could be heard despite the appellant's failure to address the cantonal refusal to restore the appeal deadline.

Solution extraite

The appeal could not be heard because the appellant did not engage with the decisive reasoning of the cantonal court and thus failed to show a violation of federal law.

Motifs extraits

The federal complaint must explain in what respect the challenged decision violates Art. 95 BGG. Since the appellant said nothing about the refusal of deadline restoration and instead argued only about fitness to serve the sentence, the appeal was insufficiently reasoned.

Question juridique clé

Whether the appellant's alleged unfitness to serve the sentence was relevant in this proceedings.

Solution extraite

No. The issue of fitness to serve a sentence was not the subject of the present appeal.

Motifs extraits

The court held that this question falls outside the scope of the federal proceedings and cannot cure the lack of reasoning regarding the cantonal decision.

Question juridique clé

Whether court costs should be charged.

Solution extraite

The court exceptionally waived costs.

Motifs extraits

An exception justified dispensing with the costs order.
