Résumé Omnilex

The Federal Supreme Court held that the appellant's submission did not address the cantonal court's reason for refusing to entertain his revision request against a criminal order. Instead, he merely repeated that he was not the offender. Because the complaint failed to engage with the decisive reasoning, the Court did not enter into it under Art. 108 BGG. Free legal aid was refused as the complaint was hopeless, and costs of CHF 500 were imposed, considering the appellant's financial situation.

Regeste Omnilex

Art. 108 BGG, Art. 64 BGG; non-entry for insufficient reasoning of a federal complaint: the appellant must deal with the decisive reasoning of the cantonal decision and indicate, in a substantiated manner, why it is contrary to federal law. A mere repetition of objections against the merits, where these were not examined below, is insufficient. If the appeal is manifestly inadmissible or hopeless, free legal aid is to be refused; court costs may be reduced having regard to the party's financial circumstances (Art. 65 Abs. 2 BGG).

Urteil vom 1. November 2012
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Einzelrichter,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Generalstaatsanwaltschaft des Kantons Bern, Maulbeerstrasse 10, 3011 Bern,
Beschwerdegegnerin.

Gegenstand
Revision (Strafmandat),

Beschwerde gegen den Beschluss des Obergerichts
des Kantons Bern, Strafabteilung, 2. Strafkammer,
vom 11. August 2012.

Der Einzelrichter zieht in Erwägung:

1.

4.
Dieses Urteil wird den Parteien und dem Obergericht des Kantons Bern, Strafabteilung, 2. Strafkammer, schriftlich mitgeteilt.

Question juridique clé

Whether the federal complaint met the reasoning requirements and could be examined on the merits.

Solution extraite

The complaint was insufficiently reasoned because it did not address the cantonal court's non-entry reasoning and only repeated the denial of guilt.

Motifs extraits

Federal review was limited to whether the lower court had to enter into the revision request. The appellant failed to engage with that question and attacked only the unexamined merits of the accusation.

Question juridique clé

Whether free legal aid should be granted.

Solution extraite

Free legal aid was denied because the complaint had no prospect of success.

Motifs extraits

As the complaint was inadmissible for lack of reasoning, the requests were deemed hopeless.

Question juridique clé

Allocation of court costs.

Solution extraite

Court costs were imposed on the appellant, taking his financial situation into account.

Motifs extraits

Costs follow the outcome; reduced assessment reflected the appellant's financial circumstances.
