Résumé Omnilex

The Federal Supreme Court treated the appellant’s filing as a criminal-law complaint because it concerned execution of a sentence, but declined to enter into the matter because the 22-page submission was querulous. The request for suspensive effect became moot. The appellant was ordered to pay court costs of CHF 800.

Regeste Omnilex

Art. 42 Abs. 7, Art. 66 Abs. 1, Art. 78 ff. and Art. 108 BGG; non-entry on querulous criminal complaint. A filing relating to sentence execution is to be treated according to its substance as a criminal-law complaint. However, where the submission is manifestly querulous, offensive or otherwise abusive in the sense of Art. 42 Abs. 7 BGG, the Federal Supreme Court may decline to enter in summary proceedings under Art. 108 BGG. A request for suspensive effect becomes moot upon non-entry. Court costs are borne by the unsuccessful appellant pursuant to Art. 66 Abs. 1 BGG.

Urteil vom 30. September 2007
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Regierungsrat des Kantons Aargau,

Gegenstand

Kammer, schriftlich mitgeteilt.

Question juridique clé

Whether the filing was admissible as a criminal-law appeal or had to be treated as querulous under the Federal Supreme Court Act.

The submission was treated as a criminal-law complaint, but it was manifestly querulous and therefore not examined in summary procedure.

Motifs extraits

Because the matter concerned execution of a sentence, the filing fell under Art. 78 ff. BGG; however, its tone and content were querulous within Art. 42(7) BGG, so no entry was made under Art. 108 BGG.

Question juridique clé

Whether the request for suspensive effect remained pending.

Solution extraite

The request became moot once the court decided not to enter on the complaint.

Motifs extraits

A decision on the merits was no longer possible after the non-entry ruling.

Question juridique clé

Allocation of court costs.

Solution extraite

Court costs were imposed on the appellant.

Motifs extraits

As the unsuccessful party, the appellant had to bear the fees under Art. 66(1) BGG.
