Résumé Omnilex

The Federal Tribunal treated the filing as a criminal appeal under the LTF because the challenged decision was rendered after 1 January 2007. It found the appeal time-barred: the cantonal order had been notified on 6 February 2007, while the appeal was filed only on 12 March 2007, beyond the 30-day period. As the appeal was manifestly hopeless, legal aid was refused. The appellant was ordered to pay reduced court costs of CHF 500.

Regeste Omnilex

Art. 100 al. 1 LTF; timeliness of a criminal appeal and consequences of late filing. The appeal must be lodged within 30 days of notification of the complete decision; expiry of the statutory period leads to inadmissibility. A manifestly untimely appeal is devoid of prospects of success within the meaning of Art. 64 al. 1 LTF and does not justify legal aid. Costs are borne by the losing party under Art. 66 al. 1 LTF; the court may reduce the fee in light of the party’s financial circumstances.

Arrêt du 27 mars 2007
Cour de droit pénal

Composition
M. le Juge Schneider, Président.
Greffier: M. Oulevey.

Parties
X.________,
recourant,

contre

Procureur général du canton de Genève,
case postale 3565, 1211 Genève 3.

Objet

Question juridique clé

Whether the criminal appeal was filed within the 30-day deadline under the Federal Supreme Court Act.

Solution extraite

The appeal was filed too late because it was lodged on 12 March 2007 after notification on 6 February 2007; it was therefore inadmissible.

Motifs extraits

Under Art. 100 para. 1 LTF, the appeal must be filed within 30 days of service of the complete decision. The filing exceeded that period.

Question juridique clé

Whether the appellant was entitled to legal aid.

Solution extraite

Legal aid was refused because the appeal had no prospects of success from the outset.

Motifs extraits

A manifestly hopeless appeal does not satisfy the condition of non-frivolousness required for legal aid under Art. 64 para. 1 LTF.

Question juridique clé

Who must bear the court costs and in what amount.

Solution extraite

The appellant must bear reduced court costs of CHF 500.

Motifs extraits

As the losing party, the appellant bears the costs under Art. 66 para. 1 LTF; the amount was reduced in view of his poor financial situation.
