Résumé Omnilex

The Federal Supreme Court did not enter into the complainant’s challenge to the cantonal court’s refusal to waive earlier costs. It held that the complaint failed to satisfy the reasoning requirement because it did not engage with the cantonal court’s decisive finding that the debt could be paid in installments if the complainant worked and reduced housing costs. The complainant was ordered to pay federal court costs of CHF 500, reduced in light of his financial situation.

Regeste Omnilex

Art. 42 Abs. 2 BGG, Art. 108 BGG; the Federal Supreme Court enters only on complaints that sufficiently challenge the decisive reasoning of the decision appealed against. A merely asserted inability to pay, without addressing the cantonal court’s alternative finding of instalment capacity, does not meet the reasoning requirement. Where the complaint is manifestly insufficiently reasoned, non-entry is ordered in summary procedure; court costs are allocated under Art. 66 Abs. 1 BGG and may be moderated under Art. 65 Abs. 2 BGG.

Urteil vom 13. Februar 2013
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Einzelrichter,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Kantonsgericht Basel-Landschaft, Abteilung Strafrecht, Bahnhofplatz 16, 4410 Liestal,
Beschwerdegegner.

Gegenstand
Kostenerlass,

Beschwerde gegen den Entscheid des Kantonsgerichts Basel-Landschaft, Abteilung Strafrecht, vom 19. Dezember 2012.

Der Einzelrichter zieht in Erwägung:

1.

Question juridique clé

Whether the complaint met the Federal Supreme Court's reasoning requirements

Solution extraite

No. The complaint did not address the decisive cantonal reasoning that the complainant could pay the costs in installments through work and lower housing costs.

Motifs extraits

The appellant failed to explain why the lower court’s central assessment was unlawful or arbitrary. This does not satisfy Art. 42(2) BGG, so the court will not enter into the complaint under Art. 108 BGG.

Question juridique clé

Allocation of federal court costs

Solution extraite

Court costs were imposed on the complainant, taking into account his financial situation.

Motifs extraits

As the complaint was not entered into, the costs are charged to the appellant under Art. 66(1) BGG, with moderation under Art. 65(2) BGG.
