Résumé Omnilex

The Federal Supreme Court did not enter into the criminal complaint against the Bern cantonal judgment for attempted coercion. It held that the appellant’s submissions did not properly challenge the conviction and, as to the cantonal costs and compensation, did not allege arbitrariness or a violation of fundamental rights as required. The appeal was therefore inadmissible in summary proceedings under Art. 108 BGG. Federal court costs of CHF 800 were imposed on the appellant.

Regeste Omnilex

Art. 42 Abs. 2 BGG; Art. 106 Abs. 2 BGG; Art. 108 BGG; inadmissibility for insufficient reasoning of a criminal complaint. A federal complaint must substantively engage with the challenged reasoning and, where cantonal cost allocations are attacked, specifically allege arbitrariness or a constitutional violation; a mere reference to the desired outcome is insufficient. The Federal Supreme Court examines only properly reasoned grievances and may issue a non-entry decision in summary procedure where the pleading requirements are not met (consid. 1).

Urteil vom 4. September 2007
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Generalprokurator des Kantons Bern, Postfach 7475, 3001 Bern.

Gegenstand

3.
Dieses Urteil wird dem Beschwerdeführer, dem Generalprokurator des Kantons Bern und dem Obergericht des Kantons Bern, 2. Strafkammer, schriftlich mitgeteilt.

Question juridique clé

Whether the complaint sufficiently challenged the conviction for attempted coercion under Art. 42(2) BGG.

Solution extraite

The complaint did not address the conviction in a reasoned manner and therefore failed to meet the federal pleading requirements.

Motifs extraits

The appellant stated he would accept the coercion judgment while still requesting acquittal; he did not engage with the merits of the conviction.

Question juridique clé

Whether the complaint adequately alleged arbitrariness or violation of fundamental rights regarding the cantonal cost and compensation order under Art. 106(2) BGG.

Solution extraite

No. The complaint did not invoke arbitrariness or fundamental-rights violations, so the challenge to costs and compensation was insufficiently reasoned.

Motifs extraits

Because the cost allocation is governed by cantonal procedural law, only a properly pleaded arbitrariness or constitutional complaint could be examined.

Question juridique clé

Whether federal court costs should be imposed on the appellant.

Solution extraite

Yes. The court costs were charged to the appellant.

Motifs extraits

As the complaint was not entered into, the appellant had to bear the costs under the Federal Supreme Court Act.
