Résumé Omnilex

The Federal Supreme Court treated the appellant's filings as a complaint under the Federal Supreme Court Act. It held that the arguments against the cantonal court's non-entry on the recusal request and against the rejection of reopening were merely unspecific and did not meet the requirements of reasoned federal review. The appeal was therefore not entered into under the simplified procedure. The request for legal aid was denied because the complaint was hopeless, and reduced court costs of CHF 500 were charged to the appellant.

Regeste Omnilex

Art. 42, Art. 64, Art. 65 Abs. 2, Art. 66 Abs. 1, Art. 108 BGG; requirements of substantiation in a federal criminal complaint and consequences of insufficient reasoning. A complaint must identify, with reference to the contested reasoning, why the decision violates federal law; mere general allegations or unsupported suspicions are insufficient. Where the appeal fails manifestly to satisfy the reasoning requirements, the court may refuse to enter into the matter in simplified procedure under Art. 108 BGG. Legal aid is denied if the proceedings are devoid of prospects of success; court costs may be reduced to reflect the party's financial circumstances.

Urteil vom 28. Mai 2009
Strafrechtliche Abteilung

Besetzung
Bundesrichter Favre, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons St. Gallen, Schützengasse 1, 9001 St. Gallen,
Beschwerdegegnerin.

Gegenstand

Question juridique clé

Whether the appeal adequately challenged the cantonal court's refusal to entertain the recusal request.

Solution extraite

The complaint was insufficiently reasoned and did not show any violation of federal law.

Motifs extraits

The appellant relied on unspecific allegations only; this did not substantiate how the lower court erred by not entering on the recusal request.

Question juridique clé

Whether the appeal adequately challenged the rejection of the request to reopen the proceedings.

Solution extraite

The complaint did not explain why the asserted facts could constitute a relevant new fact for the original conviction.

Motifs extraits

The appellant's assertions were not linked in a concrete way to a legally relevant new circumstance capable of justifying reopening.

Question juridique clé

Whether the request for legal aid should be granted.

Solution extraite

Legal aid was refused because the appeal had no prospects of success.

Motifs extraits

Under the applicable federal rules, an obviously hopeless appeal does not justify free legal assistance.

Question juridique clé

Who bears the court costs and in what amount?

Solution extraite

The appellant was ordered to pay reduced court costs of CHF 500.

Motifs extraits

Costs follow the unsuccessful appeal, with the appellant's financial situation taken into account through a reduced fee.
