Résumé Omnilex

The Federal Supreme Court held that the complaint against the cantonal criminal court’s remand order was inadmissible because the decision was not final and no exception permitting an immediate appeal was established. The remand merely returned the case to the investigating judge for further proceedings on suspected property damage. As an exception, the court waived costs and did not decide the request for free legal assistance.

Regeste Omnilex

Art. 90 and Art. 93 Abs. 1 lit. a, b BGG; non-entry on a complaint against a remand decision in criminal proceedings. A cantonal decision annulling a discontinuance and remanding the matter for further investigation is, as a rule, an interlocutory decision that does not end the proceedings. Such a decision is not immediately appealable unless the appellant shows irreparable harm or the statutory conditions for immediate review are otherwise met. Absent such showing, the Federal Supreme Court does not enter into the complaint pursuant to Art. 108 BGG. In exceptional circumstances, costs may be waived.

Urteil vom 11. Juli 2008
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Freiburg, Zaehringenstrasse 1, 1702 Freiburg,
Beschwerdegegnerin.

Gegenstand
Sachbeschädigung,

Beschwerde gegen das Urteil des Kantonsgerichts Freiburg, Strafkammer, vom 14. April 2008.

Der Präsident zieht in Erwägung:

1.
