Résumé Omnilex

The Federal Supreme Court did not enter into the criminal complaint because the appellant failed to challenge the cantonal court's decisive reason for non-entry, namely the untimely filing of the appeal registration. The submission therefore did not meet the reasoning requirement of Art. 42(2) BGG and could not be examined under Art. 108 BGG. Court costs of CHF 800 were imposed on the appellant.

Regeste Omnilex

Art. 42 Abs. 2 BGG; Art. 108 BGG; a complaint must specifically address the decisive reasons of the challenged decision. If the appellant omits any argument on the lower court's determinative ground for non-entry, the submission is manifestly insufficiently reasoned and may be declared inadmissible in summary procedure. The Federal Supreme Court does not examine the merits ex officio; the reasoning burden lies with the complainant (consid. 1). Costs follow the outcome under Art. 66 Abs. 1 BGG.

Urteil vom 14. August 2007
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Oberstaatsanwaltschaft des Kantons Zürich, Postfach, 8090 Zürich.

Gegenstand
Hausfriedensbruch etc., Widerruf,

Beschwerde in Strafsachen gegen den Beschluss des Obergerichts des Kantons Zürich, II. Strafkammer, vom 6. Juli 2007.

Der Präsident zieht in Erwägung:
1.

3.
Dieses Urteil wird dem Beschwerdeführer, der Oberstaatsanwaltschaft des Kantons Zürich und dem Obergericht des Kantons Zürich, II. Strafkammer, schriftlich mitgeteilt.
