Résumé Omnilex

The appellant challenged a cantonal non-entry decision in a matter concerning an order discontinuing proceedings for acts of violence. The Federal Court held that the complaint did not meet the substantiation requirements of Art. 42(2) BGG because it did not adequately explain any violation of federal law under Art. 95 BGG. The court therefore did not enter into the complaint under the simplified procedure of Art. 108 BGG. It also denied free legal aid as the filing had no prospects of success and ordered court costs of CHF 500 against the appellant.

Regeste Omnilex

Art. 42 Abs. 2 BGG, Art. 95 BGG; requirements for substantiation of a complaint to the Federal Court and non-entry under Art. 108 BGG. A complaint must, in reasoned form, indicate how the contested decision infringes federal law; mere criticism of the facts or of the opposing party's conduct is insufficient. If the pleading does not satisfy these requirements, the Federal Court may decline to enter into the matter in simplified procedure. Free legal aid under Art. 64 BGG is excluded where the legal remedies sought appear hopeless. Court costs may be reduced under Art. 65 Abs. 2 BGG according to the party's financial situation, but remain chargeable to the unsuccessful appellant under Art. 66 Abs. 1 BGG.

Urteil vom 4. Februar 2010
Strafrechtliche Abteilung

Besetzung
Bundesrichter Favre, Präsident,
Gerichtsschreiberin Arquint Hill.

Parteien
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Solothurn, 4502 Solothurn,
Beschwerdegegnerin.

Gegenstand

Question juridique clé

Whether the complaint met the Federal Court's substantiation requirements.

Solution extraite

It did not; the filing failed to show, in a legally sufficient manner, how the cantonal decision violated federal law.

Motifs extraits

The appellant's remarks did not engage with Art. 95 BGG in a way required by Art. 42(2) BGG; therefore the complaint was inadmissible and could be dealt with under Art. 108 BGG.

Question juridique clé

Whether the appellant was entitled to free legal aid.

Solution extraite

Free legal aid was refused because the requested relief was manifestly hopeless.

Motifs extraits

Since the complaint did not satisfy the admissibility and substantiation requirements, the requests had no prospects of success within the meaning of Art. 64 BGG.

Question juridique clé

Who must bear the court costs and in what amount.

Solution extraite

The appellant was ordered to pay court costs of CHF 500, taking his financial situation into account.

Motifs extraits

Costs were allocated to the unsuccessful appellant under Art. 66(1) BGG, with moderation of the fee under Art. 65(2) BGG.
