Résumé Omnilex

The Federal Supreme Court dismissed the complaint in summary non-entry proceedings because the complainant lacked standing to challenge the discontinuation of a criminal investigation for false accusation. She was neither a private criminal complainant under Art. 81 BGG nor a victim under the Victim Support Act, and the case did not concern the criminal complaint right itself. Court costs of CHF 800 were imposed on her; no compensation was awarded to the respondents.

Regeste Omnilex

Art. 81 Abs. 1 lit. b Ziff. 4-6 BGG; Art. 2 Abs. 1 OHG; standing to appeal against discontinuation of criminal proceedings. A mere injured party is not entitled to lodge a criminal appeal to the Federal Supreme Court. Standing requires either participation as private criminal complainant in the statutory sense, victim status with direct impairment of physical or psychological integrity, or a challenge concerning the criminal complaint right itself. Where the public prosecutor was involved in the cantonal proceedings and no victim status exists, the complaint is manifestly inadmissible and may be dealt with in the simplified non-entry procedure under Art. 108 BGG (consid. 1). Costs are borne by the unsuccessful appellant under Art. 66 Abs. 1 BGG.

Z.________,
Beschwerdegegner,
Oberstaatsanwaltschaft des Kantons Zürich, Florhofgasse 2, 8001 Zürich,
Beschwerdegegnerin.

Gegenstand
Einstellung der Untersuchung,

Beschwerde gegen den Beschluss des Obergerichts des Kantons Zürich, III. Strafkammer, vom 17. April 2008.

Der Präsident zieht in Erwägung:

1.

3.
Dieses Urteil wird den Parteien und dem Obergericht des Kantons Zürich, III. Strafkammer, schriftlich mitgeteilt.

Question juridique clé

Whether the complainant had standing under Art. 81 BGG to challenge the discontinuation of the criminal investigation.

Solution extraite

The complainant lacked standing: she was neither a private criminal complainant in the relevant sense, nor a victim under the Victim Support Act, and the case did not concern the right to file a criminal complaint as such.

Motifs extraits

Because the public prosecutor participated in the cantonal proceedings, the complainant was not a private criminal complainant within Art. 81(1)(b)(4) BGG. She was not directly impaired in physical or psychological integrity, so she was not a victim under Art. 81(1)(b)(5) BGG and Art. 2(1) OHG. The matter did not concern the criminal complaint right itself under Art. 81(1)(b)(6) BGG. As merely an injured party, she was not entitled to appeal.

Question juridique clé

Whether the appeal should be entered into under Art. 108 BGG.

Solution extraite

No. The appeal was not entered into by summary procedure.

Motifs extraits

Since the appellant lacked standing, the Federal Supreme Court could declare the appeal inadmissible under the simplified non-entry procedure of Art. 108 BGG.
