Résumé Omnilex

The Federal Supreme Court dismissed the appeal as inadmissible for lack of standing. The appellant challenged a cantonal decision confirming non-entry into criminal complaints relating to the theft of an explosives package and the crash and total loss of a loader. The court held that he was neither a private prosecutor nor a victim under the Victims' Assistance Act, because he had not suffered a direct infringement of physical, psychological, or sexual integrity. The appeal was therefore not entered into under the summary procedure, and costs of CHF 800 were charged to him.

Regeste Omnilex

Art. 81 Abs. 1 lit. b Ziff. 4 and 5 BGG; standing in criminal matters; the injured party who is neither private prosecutor nor victim within the meaning of the OHG is not entitled to appeal to the Federal Supreme Court. Participation of the public prosecutor in the cantonal proceedings excludes private-prosecutor status. Victim status requires a direct impairment of physical, psychological, or sexual integrity; purely patrimonial damage or indirect prejudice is insufficient. In the absence of standing, the appeal is manifestly inadmissible and may be disposed of under Art. 108 BGG; costs are borne by the appellant pursuant to Art. 66 Abs. 1 BGG.

Urteil vom 3. Juni 2010
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Einzelrichter,
Gerichtsschreiber Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Aargau,
Frey-Herosé-Strasse 12, Wielandhaus, 5001 Aarau,
Beschwerdegegnerin.

Gegenstand

Question juridique clé

Whether the complainant had standing to file a criminal law appeal to the Federal Supreme Court

Solution extraite

He lacked standing because he was neither a private prosecutor nor a victim whose physical, psychological, or sexual integrity was directly affected.

Motifs extraits

The prosecution had participated in the cantonal proceedings, excluding private-prosecutor status under Art. 81(1)(b)(4) BGG. The alleged acts did not directly infringe any integrity protected by the Victims' Assistance Act, so victim status under Art. 81(1)(b)(5) BGG was absent. As a merely injured party without victim status, he could not appeal.

Question juridique clé

Whether the appeal could be entered under the summary inadmissibility procedure

Solution extraite

No; the appeal was not admissible and therefore could be disposed of under Art. 108 BGG.

Motifs extraits

Because the appellant lacked standing, the court declined to enter into the merits.

Question juridique clé

Allocation of court costs

Solution extraite

Court costs of CHF 800 were imposed on the appellant.

Motifs extraits

Costs follow the unsuccessful inadmissible appeal.
