Résumé Omnilex

The complainant sought federal review of the Zurich authorities' refusal to open an investigation against officials and civil servants. The Criminal Division of the Federal Supreme Court held that he had not shown standing as required, that the complaint was insufficiently reasoned and otherwise inadmissible, and therefore did not enter into it. His request for free legal aid was denied because the complaint was hopeless. Court costs of CHF 800 were imposed on him. The request for suspensive effect became moot.

Regeste Omnilex

Art. 81 BGG, Art. 42 Abs. 2 BGG, Art. 106 Abs. 2 BGG, Art. 41 Abs. 7 BGG, Art. 108 BGG; standing and motivation requirements for criminal complaints. A complainant must demonstrate, in a concrete manner, that the conditions for appeal standing are met. A filing that does not satisfy the statutory reasoning requirements, or is otherwise procedurally inadmissible, is not entered into under Art. 108 BGG. Free legal aid under Art. 64 Abs. 1 BGG is refused where the complaint has no reasonable prospects of success; in such circumstances, a reduction of court costs is not warranted where the litigation conduct is abusive (Art. 65 Abs. 2 BGG).

Urteil vom 24. Juli 2007
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Oberstaatsanwaltschaft des Kantons Zürich, Postfach, 8090 Zürich.

Gegenstand
Eröffnung einer Untersuchung gegen Behördenmitglieder und Beamte,

Beschwerde in Strafsachen gegen den Beschluss des Obergerichts des Kantons Zürich, II. Zivilkammer, vom 25. Mai 2007 (Geschäfts-Nr. NS070008/U).

Der Präsident zieht in Erwägung:
1.

4.
Dieses Urteil wird dem Beschwerdeführer, der Oberstaatsanwaltschaft des Kantons Zürich und dem Obergericht des Kantons Zürich, II. Zivilkammer, schriftlich mitgeteilt.
