Résumé Omnilex

The Federal Criminal Court treated the subsidary constitutional complaint as a criminal law appeal. It held that the complainant lacked standing to challenge the cantonal dismissal of a criminal investigation concerning patrimonial offences, because such offences did not directly affect his personal integrity. His arguments of arbitrary fact assessment and denial of the right to be heard were therefore not examinable. The appeal was declared inadmissible, and CHF 800 in costs were imposed on the appellant.

Regeste Omnilex

Art. 113 LTF, art. 108 al. 1 let. a LTF; standing of the injured person to challenge a refusal to prosecute for patrimonial offences. The injured person is entitled to appeal against a non-prosecution order only if the offence alleged directly affects his or her physical, sexual or psychological integrity, or if a formal right independent of the merits is invoked. For offences protecting property interests alone, the complainant lacks standing to obtain review of the substantive correctness of the dismissal. Allegations framed as arbitrary fact-finding or violation of the right to be heard are not admissible where they merely seek review of the merits without establishing a separate formal grievance (consid. 2).

Arrêt du 2 juillet 2009
Cour de droit pénal

Composition
M. le Juge Favre, Président.
Greffière: Mme Gehring.

Parties
X.________,
recourant,

contre

Ministère public du canton de Vaud, 1014 Lausanne,
intimé.

Objet
