Résumé Omnilex

The Federal Court did not enter into the criminal complaint because the appellant failed to challenge the cantonal court's decisive reasoning that he lacked standing to complain about the prosecutor's decision not to open an investigation. The filing therefore did not meet the federal pleading requirements. Court costs of CHF 500 were imposed on the appellant, taking his financial situation into account.

Regeste Omnilex

Art. 42 Abs. 2, Art. 106 Abs. 2 and Art. 108 BGG; admissibility of a complaint and duty to challenge decisive reasoning: the Federal Court enters only on a sufficiently reasoned complaint that engages with each independent ground of the challenged decision. If the appellant leaves unaddressed the cantonal court's decisive holding on lack of grievance or standing, the complaint is manifestly insufficiently reasoned and non-entry follows in summary proceedings under Art. 108 BGG. Court costs may be imposed under Art. 66 Abs. 1 BGG, with due regard to financial circumstances under Art. 65 Abs. 2 BGG.

Urteil vom 24. April 2009
Strafrechtliche Abteilung

Besetzung
Bundesrichter Favre, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft Winterthur / Unterland,
Hermann Götz-Strasse 24, 8400 Winterthur,
Beschwerdegegnerin.

Gegenstand
Einstellung der Untersuchung,

Beschwerde gegen den Beschluss des Obergerichts des Kantons Zürich, III. Strafkammer, vom 24. März 2009.

Der Präsident zieht in Erwägung:

1.

3.
Dieses Urteil wird den Parteien und dem Obergericht des Kantons Zürich, III. Strafkammer, schriftlich mitgeteilt.

Question juridique clé

Whether the federal complaint met the reasoning requirements and was admissible.

Solution extraite

The complaint did not address the decisive question of standing and therefore failed to satisfy the reasoning requirements.

Motifs extraits

The lower court found the appellant was not burdened or aggrieved by the prosecutor's decision or its reasons. Because the appellant did not challenge this point before the Federal Court, the filing did not comply with Art. 42(2) and Art. 106(2) BGG, so non-entry under Art. 108 BGG was required.

Question juridique clé

Allocation of court costs before the Federal Court.

Solution extraite

Court costs were imposed on the appellant, taking his financial situation into account.

Motifs extraits

As the complaint was not admitted, the costs follow the outcome; the fee was moderated in light of the appellant's financial situation.
