Résumé Omnilex

The appellant sought to challenge a Bernese appellate conviction for extortion-related offences, arguing mainly that the evidence had been assessed incorrectly and that he had not used a real pistol. The Federal Supreme Court held that the complaint did not meet the required substantiation standards and amounted only to inadmissible appellatory criticism. It therefore did not enter into the appeal. The request for free legal aid was refused because the appeal was hopeless, and reduced court costs of CHF 500 were charged to the appellant.

Regeste Omnilex

Art. 42 Abs. 2 und Art. 106 Abs. 2 BGG; Art. 108 BGG: A criminal complaint that merely contests the assessment of evidence in appellatory terms and fails to demonstrate arbitrariness is inadmissible. A finding of arbitrariness requires more than an alternative plausible view; it must be manifestly untenable, in clear contradiction with the factual situation or shocking to equity. Where the appeal is hopeless, free legal aid under Art. 64 BGG is to be refused. Court costs follow Art. 66 Abs. 1 BGG and may be reduced according to the appellant's financial circumstances.

Urteil vom 15. Januar 2008
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiberin Arquint Hill.

Parteien
X.________,
Beschwerdeführer,

gegen

Generalprokurator des Kantons Bern, Hochschulstrasse 17, 3012 Bern,
Beschwerdegegner.

Gegenstand
Erpressung etc.,

Beschwerde gegen das Urteil des Obergerichts des Kantons Bern, 1. Strafkammer, vom 30. August 2007.

Der Präsident zieht in Erwägung:
1.
1 i.V.m. Art. 22 Abs. 1 StGB sowie im Sinne von Art. 156 Ziff. 2 sowie Ziff. 3 i.V.m. Art. 140 Ziff. 1 bzw. Ziff. I 13 E. 5.1; 131 I 57 E. 2, 217 E. 2.1, 467 E. 3.1).

Strafkammer, schriftlich mitgeteilt.

Question juridique clé

Whether the criminal appeal sufficiently challenged the cantonal court's assessment of evidence and reasoning

Solution extraite

The submissions did not meet the Federal Supreme Court's substantiation requirements; the complaint was merely appellatory and did not establish arbitrariness.

Motifs extraits

A finding is not arbitrary merely because another solution is conceivable. The appellant's assertions neither showed an obvious inconsistency nor a violation of Art. 9 BV, and his arguments failed to satisfy Arts. 42(2) and 106(2) BGG.

Question juridique clé

Whether the appellant was entitled to free legal aid

Solution extraite

Legal aid was refused because the appeal had no prospects of success.

Motifs extraits

Under Art. 64 BGG, legal aid is granted only for non-futile proceedings; given the inadmissibility and lack of merit, the request was hopeless.

Question juridique clé

Allocation of court costs

Solution extraite

Court costs were imposed on the appellant, reduced to reflect his financial situation.

Motifs extraits

Under Art. 66(1) BGG, the unsuccessful party bears costs; the fee was lowered in light of the appellant's economic circumstances.
