Résumé Omnilex

The Federal Supreme Court did not enter into the appellant's complaint against the denial of compensation in a discontinued criminal case. It held that the appeal failed to satisfy the statutory reasoning requirements, as it did not explain in a legally adequate way why the cantonal court's finding was contrary to federal law. The appellant's reference to humiliation on crowded trains was deemed insufficient. Court costs of CHF 500 were imposed on the appellant.

Regeste Omnilex

Art. 42 Abs. 2, Art. 106 Abs. 2 and Art. 108 BGG; admissibility of a complaint to the Federal Supreme Court: the appellant must, in a reasoned manner, address the challenged reasoning and show which federal law was violated. Mere rhetorical or conclusory assertions do not meet the burden of reasoning, particularly where the complaint contests the denial of compensation after discontinuance of criminal proceedings. In such a case, absent a legally sufficient challenge to the lower court's factual and legal assessment, the court will not enter into the matter; costs are charged to the appellant under Art. 66 Abs. 1 BGG.

Urteil vom 12. April 2011
Strafrechtliche Abteilung

Besetzung
Bundesrichter Favre, Präsident,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Generalstaatsanwaltschaft des Kantons Bern, Maulbeerstrasse 10, 3011 Bern,
Beschwerdegegner.

Gegenstand
Reisen ohne gültigen Fahrausweis, Entschädigung,

Beschwerde gegen den Beschluss des Obergerichts des Kantons Bern, Strafabteilung, Beschwerdekammer in Strafsachen, vom 28. März 2011.

Der Präsident zieht in Erwägung:

1.

Question juridique clé

Whether the appeal against the refusal of compensation met the Federal Supreme Court's reasoning requirements

Solution extraite

The appeal did not sufficiently show, in a manner meeting the requirements of the Federal Supreme Court Act, that the lower court had violated federal law.

Motifs extraits

The submission contained only a brief assertion about humiliation in crowded trains and failed to engage with the lower court's finding that no compensable expenses were shown; therefore the legal reasoning requirement was not met.

Question juridique clé

Whether court costs should be charged to the appellant

Solution extraite

Court costs were imposed on the appellant.

Motifs extraits

As the appeal was not entertained, the costs were allocated against the appellant under the general cost rule.
