Résumé Omnilex

X. appealed a cantonal criminal dismissal after a traffic accident causing only material damage, seeking a conviction of A. The Federal Court held that X. was not a victim within the meaning of the Victims Assistance Act and therefore lacked standing to challenge the merits of the non-lieu. Because he complained only about the factual findings and the application of substantive traffic law, the appeal was inadmissible. As the appellant failed, he was ordered to pay court costs of CHF 800.

Regeste Omnilex

Art. 81 LTF; standing of a complainant against a dismissal of criminal proceedings; a person merely harmed by an offence not covered by Art. 2 al. 1 LAVI lacks standing to challenge the substantive refusal to prosecute. He may invoke only the denial of the right to lodge a complaint under Art. 30 ff. CP or the violation of a formal procedural right granted by the applicable procedural law. Complaints limited to arbitrary fact-finding or misapplication of substantive criminal or traffic law are inadmissible (consid. 2). Costs follow the outcome under Art. 66 al. 1 LTF (consid. 3).

Arrêt du 30 juillet 2007
Cour de droit pénal

Composition
M. le Juge Wiprächtiger, Juge présidant.
Greffier: M. Oulevey.

Parties
X.________,
recourant, représenté par Me Marie-Laure Paschoud, avocate,

contre

Ministère public de l'État de Fribourg, rue de Zaehringen 1, 1700 Fribourg.

Objet

Question juridique clé

Whether the complainant had standing to challenge the dismissal and seek conviction of A.

Solution extraite

He lacked standing to contest the merits of the non-entry/dismissal because he was not a victim under the Victims Assistance Act and did not invoke denial of the right to complain or a formal procedural right.

Motifs extraits

Under Art. 81 LTF, a person merely harmed by a non-violent traffic accident has no standing to attack the substantive refusal to prosecute; only denial of complaint rights or violation of a formal procedural right could be raised.

Question juridique clé

Whether the appeal based on arbitrary fact-finding and misapplication of road traffic law was admissible.

Solution extraite

No; those complaints were directed solely at the merits of the dismissal, which the appellant could not challenge.

Motifs extraits

As the appellant had no standing to dispute the factual and legal basis of the non-lieu, the appeal was inadmissible.

Question juridique clé

Allocation of court costs.

Solution extraite

The appellant, having failed, must bear the judicial fee.

Motifs extraits

Costs follow the outcome under Art. 66(1) LTF.
