Résumé Omnilex

X. challenged a decision of the St. Gallen Department of Justice and Police refusing a family room in prison execution matters. The Federal Supreme Court treated the filing as a criminal-law appeal, but held that the cantonal decision was not final because further cantonal remedies remained available. It also noted that the appeal failed to meet the federal substantiation requirements. The court therefore did not enter into the matter and exceptionally waived court costs.

Regeste Omnilex

Art. 78 ff. BGG, Art. 80 Abs. 1 BGG, Art. 106 Abs. 2 BGG, Art. 108 BGG; admissibility of a criminal-law appeal against a cantonal prison-execution decision. A decision is amenable to criminal-law appeal only if it is final within the meaning of Art. 80 Abs. 1 BGG; where cantonal law still provides an ordinary remedy, federal review is barred. Independently of this, a complaint must comply with the strict reasoning requirements of Art. 106 Abs. 2 BGG. If either prerequisite is lacking, the Federal Supreme Court may refuse to enter into the matter under Art. 108 BGG. In exceptional circumstances, costs may be waived.

Urteil vom 19. Juni 2007
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Justiz- und Polizeidepartement des Kantons
St. Gallen, Abteilung Straf- und Massnahmenvollzug, Oberer Graben 32, 9001 St. Gallen.

Gegenstand

Mai 2007.

Das Präsidium zieht in Erwägung:
1.
Die angefochtene Verfügung erging nach dem 1. Januar 2007.

Question juridique clé

Whether the complaint was admissible as a criminal-law appeal against the cantonal decision.

Solution extraite

The filing had to be treated as a criminal-law appeal under Art. 78 ff. BGG, but the Federal Supreme Court could not hear it because the cantonal decision was not a final decision within the meaning of Art. 80 para. 1 BGG.

Motifs extraits

The challenged decision concerned prison execution matters and remained subject to further cantonal remedies under the St. Gallen procedural rules; therefore the prerequisite of a final cantonal decision was missing.

Question juridique clé

Whether the appeal met the federal substantiation requirements.

Solution extraite

The submission did not satisfy the reasoning requirements of Art. 106 para. 2 BGG.

Motifs extraits

Its arguments largely missed the point of the disputed matter, so the appeal would also have failed for insufficient reasoning.

Question juridique clé

Whether court costs should be charged.

Solution extraite

No court fee was imposed exceptionally.

Motifs extraits

The court waived costs in this case.
