Résumé Omnilex

The Federal Supreme Court held that the 61-page criminal appeal was querulous and therefore inadmissible. It did not enter into the case under Art. 108 BGG. The request for free legal assistance was rejected because the appeal was manifestly hopeless. The appellant was ordered to pay court costs of CHF 1,000, with no fee reduction granted despite the nature of the filing.

Regeste Omnilex

Art. 42 Abs. 7 BGG, Art. 108 BGG; querulous and abusive submissions are inadmissible. Where a filing, by its length, content, or repetitive character, must be qualified as querulous, the Federal Supreme Court may refuse to enter into the matter in summary procedure. Manifestly hopeless proceedings do not justify free legal assistance under Art. 64 BGG. In such cases, costs are imposed on the unsuccessful party under Art. 66 BGG; the querulous character of the proceedings may exclude any reduction of the fee under Art. 65 Abs. 2 BGG.

Urteil vom 1. Juni 2007
Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Präsident,
Gerichtsschreiber Monn.

Parteien
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Schwyz,
Archivgasse 1, 6430 Schwyz.

Gegenstand

April 2007.

Das Präsidium zieht in Erwägung:
1.
