Résumé Omnilex

The appellant challenged a cantonal criminal judgment before the Federal Supreme Court, but the complaint was filed after the 30-day deadline. Because service of the cantonal judgment occurred during the statutory suspension period, the time limit began only on 2013-01-03 and expired on 2013-02-01. The filing on 2013-02-04 was therefore late. The single judge did not enter into the appeal and ordered the appellant to pay CHF 800 in court costs.

Regeste Omnilex

Art. 100 Abs. 1, Art. 46 Abs. 1 lit. c and Art. 44 Abs. 1 BGG; timeliness of a federal appeal served during the judicial vacations. If notification of the challenged decision occurs during a statutory suspension period, the appeal period begins only after expiry of the suspension. An appeal lodged after expiration of that computed deadline is inadmissible and is not entered into in summary proceedings under Art. 108 BGG. Costs are borne by the unsuccessful appellant under Art. 66 Abs. 1 BGG.

Question juridique clé

Whether the federal criminal appeal was filed within the 30-day time limit.

Solution extraite

No. The appeal period started on 2013-01-03 and expired on 2013-02-01, so the filing on 2013-02-04 was late.

Motifs extraits

The challenged judgment was served on 2012-12-19, during the statutory suspension period under Art. 46(1)(c) BGG. Therefore the deadline began after the suspension ended, on 2013-01-03, and the appeal was out of time.

Question juridique clé

Costs of the federal proceedings

Solution extraite

Court costs are charged to the appellant.

Motifs extraits

As the appeal was not admitted, the appellant must bear the costs under Art. 66(1) BGG.
