Résumé Omnilex

The Federal Supreme Court did not enter into the criminal appeal against the Valais cantonal court's refusal to entertain a complaint about false statement. The appellant did not deal with the cantonal court's decisive finding that he lacked standing, so the appeal failed to meet the reasoning requirements of Art. 42(2) BGG. The court imposed reduced costs of CHF 500 on him, considering his financial situation.

Regeste Omnilex

Art. 42 Abs. 2 BGG; Art. 108 BGG; non-entry into an appeal for insufficient reasoning. The Federal Supreme Court enters into a complaint only if the appellant engages with the reasoning decisive for the contested decision and substantiates, in a manner tailored to the grounds relied upon, why the decision is unlawful. If the appeal does not address the central ground of the lower decision, it is manifestly insufficiently reasoned and is disposed of in the summary non-entry procedure under Art. 108 BGG. In fixing costs, the court may take the appellant’s financial circumstances into account under Art. 65 Abs. 2 BGG.

Urteil vom 14. November 2013

Strafrechtliche Abteilung

Besetzung
Bundesrichter Schneider, Einzelrichter,
Gerichtsschreiber C. Monn.

Verfahrensbeteiligte
X.________,
Beschwerdeführer,

gegen

Staatsanwaltschaft des Kantons Wallis, Amt der Region Oberwallis, Kantonsstrasse 6, 3930 Visp,
Beschwerdegegnerin.

Gegenstand
Nichtanhandnahme (falsche Aussage),
