Résumé

X. filed a constitutional complaint against a Commercial Court of Aargau judgment in an insurance dispute. She had also appealed that same judgment. The Federal Supreme Court decided the appeal the same day, set aside the cantonal judgment, and upheld X.'s claim. As a result, the constitutional complaint lost its object and was struck out as moot. The Court imposed a reduced court fee of CHF 500 on X. and awarded no compensation to the respondent.

Art. 156 Abs. 1 OG; effect of mootness on constitutional complaint and costs allocation: when the challenged decision is annulled in parallel appellate proceedings and the applicant thereby obtains the desired substantive relief, the constitutional complaint lacks a current practical interest and is struck off the docket as moot. In such a situation, the party who filed the now-moot application ordinarily bears a reduced court fee; no compensation is due to the opposing party if no compensable expense was incurred (consid. 1).

Das Bundesgericht hat nach Einsicht
in die Eingabe vom 27. Juni 2005, mit der X.________ staatsrechtliche Beschwerde gegen das Urteil des Handelsgerichts des Kantons Aargau vom 25. April 2005 eingereicht hat,

in Erwägung,
dass die Beschwerdeführerin gegen den erwähnten Entscheid auch Berufung eingereicht hat,
dass die erkennende Abteilung im Berufungsverfahren mit Urteil vom heutigen Tag das angefochtene Urteil aufgehoben und die Klage der Beschwerdeführerin gutgeheissen hat,
dass die staatsrechtliche Beschwerde dadurch gegenstandslos geworden ist,
dass bei Gegenstandslosigkeit praxisgemäss der Antrag stellenden Partei eine reduzierte Gerichtsgebühr auferlegt wird (Art. 156 Abs. 1 OG),
dass der Gegenpartei kein entschädigungspflichtiger Aufwand entstanden ist,

erkannt:
1.
Die staatsrechtliche Beschwerde wird als gegenstandslos abgeschrieben.
2.
Die Gerichtsgebühr von Fr. 500.-- wird der Beschwerdeführerin auferlegt.
3.
Dieses Urteil wird den Parteien und dem Handelsgericht des Kantons Aargau schriftlich mitgeteilt.
