The Federal Supreme Court dealt with a public-law appeal by Banca A.________ against a cantonal appellate decision concerning a witness summons and two production orders. After the court president requested an advance of CHF 2,500 for costs, the bank's payment order reached PostFinance only after the deadline. The Court held the advance payment untimely and therefore did not examine the appeal on the merits. To comply with a court-fixed time limit for an advance on presumed legal costs, the paying party must ensure that the payment order reaches the Swiss postal system no later than the last day of the time limit and that the due date indicated is at the latest that last day (consid. 2a). If the transfer reaches the postal service only after expiry, the advance is untimely and the appeal is not entered into. Costs caused by the inadmissible filing are borne by the party that caused them; compensation may be awarded for submissions rendered necessary by the request for suspensive effect.

ricorso di diritto pubblico [OG] contro la sentenza emanata il 29 novembre 2006 dalla I Camera civile
del Tribunale d'appello del Cantone Ticino.

Considerando:
che con sentenza 29 novembre 2006 la I Camera civile del Tribunale d'appello del Cantone Ticino ha respinto, in quanto ricevibile, un appello presentato dalla banca A.________ contro la citazione di un testimone e due decreti di edizione;
che essendo la decisione impugnata stata emanata nel 2006 è applicabile l'OG (art. 132 cpv. 1 LTF);
che con ricorso di diritto pubblico del 19 gennaio 2007, previa concessione dell'effetto sospensivo, la banca A.________ postula l'annullamento della decisione cantonale;
che il presidente della II Corte civile ha invitato la ricorrente il 23 gennaio 2007 ad anticipare entro il 7 febbraio 2007 fr. 2'500.-- in garanzia delle spese processuali presunte, con l'avvertenza che in caso di assenza di pagamento entro il termine assegnato il rimedio sarebbe stato dichiarato inammissibile;
che nella fattispecie in esame la somma richiesta è giunta il 12 febbraio 2007 sul conto corrente postale della Cassa del Tribunale federale;
che secondo informazioni assunte da quest'ultima presso la Postfinance, l'ordine di pagamento elettronico (OPAE) le è stato teletrasmesso dalla banca A.________ il 9 febbraio 2007 e indicava quale scadenza tale giorno;
che al fine di salvaguardare il termine assegnato per il pagamento di un anticipo per spese giudiziarie presunte, la banca che effettua il pagamento deve indicare quale data di scadenza al più tardi l'ultimo giorno del termine impartito e far pervenire entro tale data l'ordine di pagamento alla Posta svizzera (cfr. DTF 117 Ib 220 consid. 2a);
che pertanto il versamento dell'anticipo spese è tardivo, l'ordine di pagamento essendo giunto alla Posta svizzera dopo la scadenza del termine fissato dal presidente con una data posteriore a quella stabilita nella richiesta dell'anticipo spese;
che in queste circostanze l'impugnativa non può essere vagliata nel merito (art. 150 cpv. 4 OG);

che le spese inutili sono sostenute da chi le ha cagionate (art. 156 cpv. 6 OG) e che pertanto si giustifica assegnare all'opponente ripetibili per le osservazioni alla domanda di conferimento dell'effetto sospensivo (art. 159 cpv. 5 OG).

Per questi motivi, visto l'art. 36a OG, il Tribunale federale pronuncia:

Il ricorso è inammissibile.
2.
La tassa di giustizia di fr. 500.-- è posta a carico della ricorrente, che rifonderà all'opponente fr. 500.-- per ripetibili della sede federale.
3.
Comunicazione ai patrocinatori delle parti e alla I Camera civile del Tribunale d'appello del Cantone Ticino.
