The Federal Supreme Court noted that the complainant withdrew his constitutional complaint on 5 February 2010. The II. Civil Law Division therefore struck the proceedings off the docket by presidential order. It also ordered the complainant to pay court costs of CHF 300. The order was notified to the parties and the Zurich Higher Court.
Art. 32 Abs. 2 BGG; Art. 71 BGG i.V.m. Art. 73 BZP; withdrawal of a constitutional complaint and allocation of costs. Where the appellant withdraws the remedy, the president may, without further merits examination, strike the proceedings off as concluded by withdrawal. In such a case, costs are generally imposed on the withdrawing party pursuant to the federal cost rules and the applicable supplementary provisions of the BZP. The discontinuance is a procedural order and does not entail a substantive review of the challenged cantonal decision.

in Erwägung,
dass der Beschwerdeführer die erwähnte Eingabe mit Schreiben vom 5. Februar 2010 zurückgezogen hat, die Verfassungsbeschwerde daher durch die Abteilungspräsidentin (Art. 32 Abs. 2 BGG) abzuschreiben ist (Art. 71 BGG i.V.m. Art. 73 BZP) und die Kosten dem Beschwerdeführer aufzuerlegen sind (Art. 71 BGG i.V.m. Art. 5 Abs. 2 BZP, Art. 66 Abs. 1 BGG),
verfügt die Präsidentin:

Das Verfahren wird als durch Rückzug der Verfassungsbeschwerde erledigt abgeschrieben.
2.
Die Gerichtskosten von Fr. 300.-- werden dem Beschwerdeführer auferlegt.
3.
Diese Verfügung wird den Parteien und dem Obergericht des Kantons Zürich schriftlich mitgeteilt.
