In a debt-enforcement supervisory appeal concerning the valuation of pledged property, the appellant withdrew the appeal after the Federal Tribunal had ordered an advance on costs. The President of the II Civil Law Court took note of the withdrawal and ordered the case struck from the roll. Court costs of CHF 300 were charged to the appellant. The order was communicated to the parties and to the cantonal supervisory court.

Where the proceedings are terminated by withdrawal, the court assigns costs pursuant to Art. 66 al. 1 and 2 LTF, unless special circumstances justify a different allocation. The withdrawal renders the merits moot; no substantive review is carried out (consid. 1-2).
