Résumé

The Federal Supreme Court noted the appellant's withdrawal of his civil appeal against the decision of the Tribunal d'Hérens et Conthey concerning objection for failure to return to better fortune. The Court struck the case from the roll and ordered the appellant to pay judicial costs of CHF 300. The order also directed that it be communicated to the parties and the lower court.

Art. 73 PCF in conjunction with Art. 71 LTF; Art. 32 al. 2 LTF: where the appellant withdraws the appeal, the Federal Supreme Court takes note of the withdrawal and strikes the case from the roll. Costs follow the withdrawal and are charged to the withdrawing party under Art. 5 al. 2 PCF by analogy via Art. 71 LTF and Art. 66 al. 1 and 2 LTF.

Vu:
le recours en matière civile du 10 novembre 2008;
l'ordonnance présidentielle du 1er décembre 2008, impartissant notamment au recourant un délai supplémentaire de dix jours pour verser l'avance de frais, par 2'000 fr.;
la déclaration de retrait du recours du 16 décembre 2008;

considérant:
qu'il convient de prendre acte de ce retrait et de rayer la cause du rôle (art. 73 PCF par renvoi de l'art. 71 LTF; art. 32 al. 2 LTF);
que les frais doivent être mis à la charge du recourant (art. 5 al. 2 PCF par renvoi de l'art. 71 LTF; art. 66 al. 1 et 2 LTF);
par ces motifs, le Président ordonne:

Il est pris acte du retrait du recours et la cause est rayée du rôle.

2.
Les frais judiciaires, arrêtés à 300 fr., sont mis à la charge du recourant.

3.
La présente ordonnance est communiquée aux parties et au Tribunal d'Hérens et Conthey.
