Résumé Omnilex

The Federal Supreme Court examined a complaint against a cantonal supervisory decision in debt enforcement concerning a register extract. It held that the appellant did not challenge the cantonal reasoning in a manner satisfying Art. 42(2) BGG, so the complaint was manifestly inadmissible and was not entered into under the simplified procedure. Because the appeal had no prospect of success, the request for free legal aid was refused. Court costs of CHF 500 were imposed on the appellant.

Regeste Omnilex

Art. 42 Abs. 2 BGG; Art. 108 Abs. 1 lit. b BGG; admissibility of a federal complaint: the statement of grounds must engage in a comprehensible manner with the reasons of the challenged decision; a merely appellatory or insufficiently reasoned submission is manifestly inadmissible. In such a case the President may refuse entry in summary procedure. Art. 64 Abs. 1 BGG requires prospects of success for legal aid; if these are lacking, the request must be denied. Costs follow Art. 66 Abs. 1 BGG and are charged to the unsuccessful complainant.

Urteil vom 8. Oktober 2008
II. zivilrechtliche Abteilung

Besetzung
Bundesrichter Raselli, Präsident,
Gerichtsschreiber Zbinden.

Parteien
X.________,
Beschwerdeführer,

gegen

Betreibungsamt Y.________ und Z.________,
Beschwerdegegner.

Gegenstand
Betreibungsregisterauszug,

September 2008.

Nach Einsicht
in den vorgenannten Entscheid,
in die Beschwerde vom 7. Oktober 2008 gegen diesen Entscheid,

in Erwägung,
