The Federal Supreme Court took note of the appellant’s withdrawal of its civil appeal against a cantonal bankruptcy appellate judgment. The case was struck off the roll. The court ordered the appellant to pay a judicial fee of CHF 300. The order was issued in writing by the presiding judge of the IIe Cour de droit civil.
Art. 32 al. 2 LTF; art. 73 PCF in relation with art. 71 LTF; withdrawal of the appeal and striking the case from the roll. When the appellant withdraws the federal appeal, the Federal Supreme Court merely takes formal note of the withdrawal and removes the case from the docket. In principle, the judicial fee is borne by the withdrawing party pursuant to art. 66 al. 1 LTF; the order is issued without further merits review (consid. 1).

Un émolument judiciaire de 300 fr. est mis à la charge de la recourante.

La présente ordonnance est communiquée en copie aux mandataires des parties et à l'Autorité de recours en matière de faillite du Tribunal cantonal du canton du Valais, ainsi qu'à l'Office des poursuites et des faillites de St-Maurice.
