Résumé Omnilex

The Federal Supreme Court did not enter into the appeal in a dispute over definitive debt collection enforcement because the appellant failed to pay the ordered CHF 2,500 cost advance within the non-extendable deadline and did not provide the required proof of timely payment. The court therefore issued a non-entry decision and imposed court costs of CHF 500 on the appellant.

Regeste Omnilex

Art. 62 Abs. 3, Art. 48 Abs. 4 and Art. 108 Abs. 1 lit. a BGG; non-entry for failure to pay the cost advance within the non-extendable deadline. Where a party, after warning, neither pays the ordered advance nor proves timely debit of the amount to a Swiss post or bank account in the manner required by Art. 48 Abs. 4 BGG, the appeal is not entered into. The remedy of non-entry applies automatically upon expiry of the deadline; the court has no discretion to examine the merits. Court costs are borne by the party whose remedy is not entertained (Art. 66 Abs. 1 BGG).

vertreten durch das Oberamt Region Solothurn.

Gegenstand
Definitive Rechtsöffnung,

Beschwerde nach Art. 72ff. BGG gegen das Urteil vom 4. Februar 2009 des Obergerichts des Kantons Solothurn (Zivilkammer).

Nach Einsicht
in die Beschwerde nach Art. 72ff. BGG gegen das Urteil vom 4. Februar 2009 des Obergerichts des Kantons Solothurn,

in Erwägung,
Question juridique clé

Whether the appeal was admissible despite non-payment of the cost advance within the set deadline.

Solution extraite

The appeal could not be examined because the appellant neither paid the advance nor proved timely payment by debit confirmation within the non-extendable deadline.

Motifs extraits

After the unsuccessful request for free legal aid, the court ordered payment of the advance and warned of non-entry. Since the appellant did not comply with the requirements under Art. 62(3) BGG and the proof rules of Art. 48(4) BGG, non-entry followed under Art. 108(1)(a) BGG.

Question juridique clé

Who bears the court costs of the federal proceedings?

Solution extraite

The appellant was ordered to pay the court costs of CHF 500.

Motifs extraits

Because the appeal was not entered into, costs were imposed on the appellant under Art. 66(1) BGG.
