The Federal Supreme Court took note of the appellant’s withdrawal of the civil appeal against the Geneva Court of Justice decision in review proceedings concerning provisional measures. It struck the case from the docket and ordered the appellant to pay judicial costs of CHF 1,000. Earlier requests for suspensive effect, urgent provisional measures and waiver of the advance on costs had already been declared inadmissible, and the appellant had been granted an additional period to pay the advance.
Art. 73 PCF in conjunction with Art. 71 LTF; Art. 32 al. 2 LTF; withdrawal of an appeal: upon valid withdrawal, the Federal Supreme Court takes note thereof and strikes the case from the roll. Costs are allocated according to the general rule of Art. 66 LTF; the withdrawing appellant normally bears the judicial costs, unless special circumstances justify a departure.

l'ordonnance présidentielle du 11 janvier 2010, déclarant ces requêtes irrecevables et invitant le recourant à verser une avance de frais de 3'000 fr. dans un délai de dix jours, conformément à l'art. 62 al. 1 LTF;
l'ordonnance présidentielle du 28 janvier 2010, accordant au recourant un délai supplémentaire de dix jours pour payer l'avance de frais, conformément à l'art. 62 al. 3 LTF;
la déclaration de retrait du recours du 8 février 2010;
considérant:
qu'il convient de prendre acte de ce retrait et de rayer la cause du rôle (art. 73 PCF par renvoi de l'art. 71 LTF; art. 32 al. 2 LTF);
que les frais doivent être mis à la charge du recourant (art. 5 al. 2 PCF par renvoi de l'art. 71 LTF; art. 66 al. 1 et 2 LTF);
par ces motifs, la Présidente ordonne:

Il est pris acte du retrait du recours et la cause est rayée du rôle.

Les frais judiciaires, arrêtés à 1'000 fr., sont mis à la charge du recourant.

Once the appeal was withdrawn, there was no need for further adjudication; the case had to be removed from the roll.
