The Federal Supreme Court took note of the appellants’ written withdrawal of their constitutional complaint after an out-of-court settlement concerning precautionary evidence proceedings before the Commercial Court of Bern. The proceeding was therefore removed from the docket. In line with the parties’ settlement statement, court costs of CHF 600 were shared equally, and no party compensation was awarded.
Withdrawal of appeal; costs and party compensation in case of settlement: where an appeal is withdrawn following an out-of-court settlement, the proceedings are struck off. If the parties agree on the allocation of costs, the court will normally follow that agreement; in particular, court costs may be apportioned equally and no party compensation awarded (consid. 1).

In Erwägung,
dass die Beschwerdeführer die Beschwerde gegen den Entscheid des Handelsgerichts des Kantons Bern vom 20. März 2012 mit Schreiben vom 21. Juni 2012 unter Hinweis auf einen aussergerichtlichen Vergleich vom 31. Mai 2012 zurückgezogen haben;
dass in diesem Schreiben festgehalten wird, die Parteien hätten vereinbart, dass die Gerichtskosten halbiert und die Parteikosten wettgeschlagen würden;
verfügt die Präsidentin:
1.
Das Verfahren wird infolge Rückzugs der Beschwerde abgeschrieben.
2.
Die Gerichtskosten von Fr. 600.-- werden den Beschwerdeführern und den Beschwerdegegnern je zur Hälfte auferlegt.
3.
Es werden keine Parteientschädigungen zugesprochen.
4.
Diese Verfügung wird den Parteien und dem Handelsgericht des Kantons Bern schriftlich mitgeteilt.
