Résumé Omnilex

The appellant challenged a cantonal decision concerning a small monetary claim. The Federal Supreme Court held that an ordinary civil appeal was unavailable because the amount in dispute did not meet the statutory threshold and no question of fundamental importance was shown. The filing was therefore treated as a subsidiary constitutional complaint. However, the complaint merely alleged constitutional violations in a general way and did not engage with the reasoning of the cantonal decision, so the Court did not enter into it. Court costs of CHF 300 were imposed on the appellant.

Regeste Omnilex

Art. 72 ff., 74 Abs. 1 lit. b, Abs. 2 lit. a, 113 ff., 116, 42 Abs. 2, 106 Abs. 2, 117 and 108 Abs. 1 lit. b BGG; subsidiary constitutional complaint: where the value in dispute does not reach the statutory threshold and no question of fundamental importance is shown, ordinary civil appeal is excluded and a filing is to be treated as a subsidiary constitutional complaint. Such complaint may invoke only constitutional rights and must, in a manner directed to the considerations of the challenged decision, identify the specific rights allegedly violated; merely abstract or global assertions are insufficient and lead to non-entry (consid. 1-2). Costs are borne by the unsuccessful complainant under Art. 66 Abs. 1 BGG.

Urteil vom 17. Februar 2009
I. zivilrechtliche Abteilung

Besetzung
Bundesrichterin Klett, Präsidentin,
Gerichtsschreiber Huguenin.

Parteien
A.________,
Beschwerdeführer,

gegen

B.________,
Beschwerdegegner.

Gegenstand
Auftrag,

Verfassungsbeschwerde gegen den Beschluss des Obergerichts des Kantons Bern, Appellationshof, 2. Zivilkammer, vom 15. Januar 2009.

In Erwägung,
dass die Gerichtspräsidentin 1 des Gerichtskreises III Aarberg-Büren-Erlach den Beschwerdeführer auf Klage des Beschwerdegegners mit Entscheid vom 4. November 2008 zur Zahlung von Fr. 295.-- nebst 5 % Zins seit 13. März 2007 verpflichtete;
dass der Beschwerdeführer diesen Entscheid mit Nichtigkeitsklage beim Obergericht des Kantons Bern anfocht und dieses mit Beschluss vom 15. Januar 2009 feststellte, dass die Nichtigkeitsklage mangels Zahlung des verlangten Gerichtskostenvorschusses dahingefallen sei, und das Nichtigkeitsklageverfahren als erledigt vom Protokoll abschrieb;
dass der Beschwerdeführer dem Bundesgericht eine vom 22. Januar 2009 datierte Eingabe einreichte, in der er erklärte, gegen den Beschluss des Obergerichts vom 15. Januar 2009 Beschwerde zu erheben;
dass die Beschwerde in Zivilsachen nach Art. 72 ff. BGG nicht erhoben werden kann, weil der erforderliche Mindeststreitwert von Fr. 30'000.-- (Art. 74 Abs. 1 lit. b BGG) nicht erreicht wird und sich keine Rechtsfrage von grundsätzlicher Bedeutung im Sinne von Art. 74 Abs. 2 lit. a BGG stellt;
dass die Eingabe des Beschwerdeführers unter diesen Umständen als subsidiäre Verfassungsbeschwerde im Sinne der Art. 113 ff. BGG behandelt werden muss;
dass mit einer solchen Beschwerde ausschliesslich die Verletzung von verfassungsmässigen Rechten gerügt werden kann (Art. 116 BGG);
dass in der Beschwerdeschrift dargelegt werden muss, welche verfassungsmässigen Rechte durch das kantonale Gericht verletzt worden sind, und solche Rügen unter Bezugnahme auf die Erwägungen des angefochtenen Entscheides zu begründen sind (Art. 42 Abs. 2 und Art. 106 Abs. 2 in Verbindung mit Art. 117 BGG);
dass in der Beschwerdeschrift zwar behauptet wird, der angefochtene Entscheid verstosse gegen verfassungsrechtliche Garantien, diese Behauptungen aber pauschal formuliert sind und deshalb nicht erkennen lassen, inwiefern der Beschluss des Obergerichts verfassungsmässige Rechte des Beschwerdeführers verletzen soll;
dass damit auf die Beschwerde mangels hinreichender Begründung nicht einzutreten ist (Art. 108 Abs. 1 lit. b BGG);
dass die Gerichtskosten dem Beschwerdeführer aufzuerlegen sind (Art. 66 Abs. 1 BGG);

erkennt die Präsidentin:

1.
Auf die Beschwerde wird nicht eingetreten.

2.
Die Gerichtskosten von Fr. 300.-- werden dem Beschwerdeführer auferlegt.

3.
Dieses Urteil wird den Parteien und dem Obergericht des Kantons Bern, Appellationshof, 2. Zivilkammer, schriftlich mitgeteilt.

Question juridique clé

Whether an appeal in civil matters was available despite the low amount in dispute.

Solution extraite

An appeal in civil matters was unavailable because the minimum value in dispute was not reached and no legal question of fundamental importance arose.

Motifs extraits

The amount in dispute was below CHF 30,000 and the case did not raise a legal question of fundamental importance, so only subsidiary constitutional complaint was possible.

Question juridique clé

Whether the filing should be treated as a subsidiary constitutional complaint.

Solution extraite

The filing had to be treated as a subsidiary constitutional complaint.

Motifs extraits

Because ordinary civil appeal routes were closed, the Court recharacterized the submission accordingly.

Question juridique clé

Whether the constitutional complaint was sufficiently reasoned.

Solution extraite

The complaint was insufficiently reasoned and therefore inadmissible.

Motifs extraits

The appellant invoked constitutional guarantees only in a general and abstract way without showing, by reference to the challenged reasoning, which constitutional rights were violated.

Question juridique clé

Who bears the court costs of the federal proceedings.

Solution extraite

The appellant must bear the court costs.

Motifs extraits

As the filing was not entered into, costs were imposed on the appellant under the governing rule on costs.
