Résumé

The appellant withdrew his appeal against the St. Gallen Cantonal Court judgment. The Federal Supreme Court therefore discontinued the proceedings and struck the case off the list. In line with the applicable procedural rules, the court fee of CHF 2,000 was imposed on the appellant. The order was communicated to the parties and to the Cantonal Court of St. Gallen, Third Civil Chamber.

Art. 5 Abs. 2, Art. 73 Abs. 1 BZP in conjunction with Art. 40 OG; withdrawal of appeal and costs: upon valid withdrawal of an appeal, the Federal Supreme Court discontinues the proceedings without a merits determination and strikes the case off; the withdrawing party ordinarily bears the court costs. The dispositive effect is termination of the appellate proceedings, not a substantive adjudication of the disputed claim.

dass der Kläger seine Berufung gegen das Urteil des Kantonsgerichts St. Gallen vom 7./8. Juni 2001 mit Schreiben vom 18. Oktober 2007 zurückgezogen hat;

in Anwendung von Art. 5 Abs. 2 und Art. 73 Abs. 1 BZP in Verbindung mit Art. 40 OG verfügt:

Das Verfahren wird als durch Rückzug der Berufung erledigt abgeschrieben.
2.
Die Gerichtsgebühr von Fr. 2'000.-- wird dem Kläger auferlegt.
3.
Diese Verfügung wird den Parteien und dem Kantonsgericht St. Gallen, III. Zivilkammer, schriftlich mitgeteilt.
