X.________ SA filed a federal appeal against a Geneva first-instance decision concerning dissolution of a company. Before the Federal Court ruled on the merits, the appellant’s lawyer informed the court by letter that the appeal was withdrawn. The President of the First Civil Law Court took note of the withdrawal, ordered the case struck from the docket under Art. 32 para. 2 LTF, and charged judicial costs of CHF 200 to the appellant.
Art. 32 al. 2 LTF; withdrawal of the appeal and removal from the docket. When the appellant validly withdraws the appeal, the Federal Court strikes the case off the roll without examining the merits. The costs of the proceedings are then allocated to the appellant in accordance with the withdrawal, absent special circumstances justifying another allocation.
