Résumé

The Federal Supreme Court did not enter into the appeal in a tenancy dispute because the appellant failed to pay the ordered cost advance even within the additional deadline. The court applied Art. 62(3) BGG and decided the matter in simplified procedure under Art. 108(1)(a) BGG. Court costs of CHF 500 were charged to the appellant under Art. 66(1) BGG.

Art. 62 Abs. 3 BGG; Art. 108 Abs. 1 lit. a BGG; non-payment of the advance on costs within the extended deadline results in non-entry into the appeal. Where the advance is not timely paid despite a grace period, the Federal Supreme Court may decide in simplified procedure and must declare the appeal inadmissible. Court costs are borne by the appellant under Art. 66 Abs. 1 BGG.

dass die Gerichtskosten der Beschwerdeführerin aufzuerlegen sind (Art. 66 Abs. 1 BGG);

erkennt die Präsidentin:

Auf die Beschwerde wird nicht eingetreten.

Die Gerichtskosten von Fr. 500.-- werden der Beschwerdeführerin auferlegt.

Dieses Urteil wird den Parteien und dem Appellationsgericht des Kantons Basel-Stadt, Ausschuss, schriftlich mitgeteilt.
