Résumé Omnilex

X.________ SA filed a federal civil appeal against a Geneva first-instance order concerning the dissolution of a corporation. While the federal appeal was pending, the Geneva Court of Justice annulled the first-instance order. The Federal Supreme Court held that the appeal had become moot and struck the case from the docket. No court fee was imposed, because the appeal had been filed after an erroneous indication of remedies by the first-instance court. The canton of Geneva was ordered to pay the appellant CHF 1,000 in party costs.

Regeste Omnilex

Art. 32 al. 2 LTF; mootness of an appeal after the cantonal appellate authority annuls the challenged decision. Where the impugned judgment has been set aside and the cantonal decision is in force, the federal appeal loses its object and must be removed from the docket. If the appeal was triggered by an erroneous indication of remedies by the lower court, no court fee need be charged to the appellant. Under Art. 68 al. 4 in relation with Art. 66 al. 3 LTF, the appellant may nonetheless be awarded party costs against the canton where it incurred unnecessary expenses caused by the incorrect remedy instruction, provided equity so requires.

Objet

Vu le recours en matière civile interjeté le 27 avril 2009 par X.________ SA contre l'ordonnance rendue le 24 mars 2009 par le Tribunal de première instance du canton de Genève dans la cause précitée;

Vu le recours formé auprès de la Cour de justice du canton de Genève par X.________ SA contre la même ordonnance;
Vu l'ordonnance présidentielle du 1er mai 2009 suspendant la procédure de recours fédérale jusqu'à droit connu sur le recours cantonal;
Vu l'arrêt du 9 juillet 2009 par lequel la Cour de justice du canton de Genève a annulé l'ordonnance du 24 mars 2009;

qu'il convient, partant, de rayer la présente cause du rôle, en application de l'art. 32 al. 2 LTF;

qu'il ne convient pas non plus de mettre les frais de la procédure fédérale à la charge du canton concerné - ce qui serait en soi possible (Thomas Geiser, in Commentaire bâlois, Bundesgerichtsgesetz, 2007, n° 25 ad art. 66; Bernard Corboz, in Commentaire de la LTF, 2009, n° 9 ad art. 49) - dès lors que l'indication erronée des voies de droit a été donnée dans un domaine où règne un certain flou, selon l'expression utilisée par la Cour de justice dans son arrêt du 9 juillet 2009;

Question juridique clé

Whether the federal appeal remained pending after the cantonal court annulled the challenged first-instance order.

Solution extraite

The appeal became moot because the cantonal judgment annulled the challenged order and was in force.

Motifs extraits

Once the cantonal appellate decision annulled the first-instance order, there was no longer a live object for the federal appeal; the case had to be struck from the docket under Art. 32(2) LTF.

Question juridique clé

Whether court costs should be charged to the appellant or the canton.

Solution extraite

No court fee was levied, and no federal costs were charged to the canton.

Motifs extraits

The appellant should not bear a fee because the federal appeal was triggered by an erroneous indication of remedies by the first-instance court. However, the circumstances did not justify charging the canton with federal procedural costs.

Question juridique clé

Whether the appellant was entitled to costs for its legal expenses.

Solution extraite

The canton of Geneva was ordered to pay the appellant CHF 1,000 in party costs.

Motifs extraits

The appellant should not suffer the unnecessary expenses caused by the erroneous indication of remedies; therefore, an indemnity for costs was justified under the LTF cost rules.
