Whether the insurer could rely on a private medical report as evidence under the Swiss Code of Civil Procedure.
A private medical report is not a court-appointed expert opinion and therefore is not a means of proof in civil proceedings; it may only be treated as a party assertion, possibly supported by other evidence.
Article 168 ZPO exhaustively lists means of proof. Systematically and in light of Articles 183 ff. ZPO and the legislative materials, only court-appointed expert opinions qualify as expert evidence. A private report cannot be smuggled in as a document to prove its contents; if disputed, it does not by itself establish the facts.
