Résumé Omnilex

The Federal Supreme Court dismissed a taxpayer’s public-law appeal in a cantonal tax matter because the lawyer did not submit the required power of attorney after being granted a deadline to cure the defect. The court held that, once the deadline expired without compliance, the filing could not be considered and was manifestly inadmissible under the simplified procedure. Federal court costs of CHF 1,000 were charged to counsel.

Regeste Omnilex

Art. 40 al. 2, art. 42 al. 5 and art. 108 al. 1 let. a LTF; lack of proof of authority of the representative. Where a party acts through a mandataire before the Federal Supreme Court, the mandataire must prove his powers by power of attorney. If this document is missing, the court grants an appropriate time limit to remedy the defect and warns that, failing cure, the submission will not be considered. Expiry of the time limit without production of the power of attorney entails manifest inadmissibility and summary treatment under art. 108 al. 1 let. a LTF. Court costs may be imposed on counsel under art. 66 al. 3 LTF (consid. 3-4).

Arrêt du 5 avril 2011
IIe Cour de droit public

Composition
M. le Juge Zünd, Président.
Greffier: M. Dubey.

Participants à la procédure
X.________, représenté par Me Y.________, avocat,
recourant,

contre

Administration fiscale cantonale genevoise, rue du Stand 26, 1204 Genève.

Objet

Question juridique clé

Whether the appeal could be considered despite the absence of a power of attorney for the lawyer

Solution extraite

The appeal could not be considered because the lawyer did not produce the required authorization within the set time limit.

Motifs extraits

Under Art. 40(2) LTF, representatives must prove their authority by power of attorney. If it is missing, the court fixes a deadline under Art. 42(5) LTF; expiry of that deadline without compliance makes the filing inadmissible.

Question juridique clé

Allocation of federal court costs after manifest inadmissibility

Solution extraite

Court costs were charged to the lawyer.

Motifs extraits

Because the appeal was manifestly inadmissible and decided under the simplified procedure, costs were imposed on counsel under Art. 66(3) LTF.
