Résumé Omnilex

The appellant sought correction of a fiscal property valuation and challenged cantonal judgments from 1992 and 1996. The Federal Supreme Court held that any appeal was manifestly out of time under Art. 100 LTF, since the 30-day deadline had long expired. It therefore applied the simplified procedure under Art. 108 LTF, found the appeal inadmissible, and charged the appellant CHF 600 in court costs under Art. 66 al. 1 LTF.

Regeste Omnilex

Art. 100 LTF, Art. 108 al. 1 let. a LTF: an appeal lodged against a cantonal decision after expiry of the 30-day period is manifestly inadmissible; the Federal Supreme Court may decide summarily under Art. 108 LTF without written submissions. Late filings do not reopen or correct earlier cantonal judgments. Where the appeal is unsuccessful, judicial costs are borne by the appellant pursuant to Art. 66 al. 1 LTF.

Arrêt du 23 mai 2011
IIe Cour de droit public

Composition
M. le Juge Zünd, Président.
Greffier: M. Dubey.

Participants à la procédure
X.________, recourant,

contre

Question juridique clé

Whether the appeal against the cantonal tax valuation judgments was timely filed

Solution extraite

The appeal was out of time because the statutory 30-day deadline had expired years earlier.

Motifs extraits

Under Art. 100 LTF, a challenge must be filed within 30 days of full service of the decision; the contested cantonal judgments were issued in 1992 and 1996, so any federal appeal was clearly late.

Question juridique clé

Whether simplified procedure could be used without exchanges of written submissions

Solution extraite

Yes; the manifest inadmissibility justified simplified treatment without a round of submissions.

Motifs extraits

Because the appeal was manifestly inadmissible under Art. 108 al. 1 let. a LTF, the court could decide summarily under Art. 108 LTF.
