Résumé Omnilex

The Federal Supreme Court dismissed as manifestly inadmissible the appeal brought by four Ecuadorian nationals against the Federal Administrative Court’s confirmation of a removal order. It held that a public law appeal is excluded under the LTF in removal matters and that a subsidiary constitutional complaint is not available against a Federal Administrative Court judgment. The request for suspensive effect was moot. The appellants were ordered to pay CHF 800 in court costs jointly and severally and received no costs indemnity.

Regeste Omnilex

Art. 83 lit. c ch. 4 LTF, art. 113 LTF; admissibility of remedies against removal from Switzerland. The public law appeal is excluded against decisions concerning removal from Switzerland. A subsidiary constitutional complaint is inadmissible against judgments of the Federal Administrative Court. If the appeal is manifestly inadmissible, the court may decide under the simplified procedure of art. 108 LTF without exchanging written submissions. Ancillary requests, such as suspensive effect, become moot. As losing parties, the appellants bear the federal court costs jointly and severally and have no entitlement to party compensation (arts. 66 para. 1 and 68 para. 2 LTF).

Objet
Renvoi de Suisse,

recours contre l'arrêt du Tribunal administratif fédéral, Cour III, du 16 janvier 2012.

Considérant en fait et en droit:

1.

113 LTF a contrario).

4.
