The Federal Supreme Court dismissed the administrative law appeal against the cantonal refusal to grant a residence permit. It held that the appellant’s marriage to a Swiss citizen, although formally existing, was correctly treated as a sham marriage because the spouses never established a common household. As a result, Art. 7 ANAG conferred no entitlement to a permit, and the cantonal authorities were not required to conduct an interests balancing. The appeal was decided in simplified summary proceedings under Art. 36a OG. The request for interim measures became moot, and court costs of CHF 1,000 were charged to the appellant.
Art. 7 ANAG; sham marriage and entitlement to a residence permit: A formally valid marriage with a Swiss citizen does not create a right to a residence permit where the factual findings, binding under Art. 105 Abs. 2 OG, establish that the union is merely an immigration marriage or sham marriage. In such a case, Art. 7 Abs. 2 ANAG excludes any claim, and the authority may refuse the permit without engaging in a further balancing of interests. If the appeal is manifestly unfounded, the Federal Supreme Court may decide in simplified proceedings under Art. 36a OG; the appeal costs follow Art. 156 OG.
