Résumé Omnilex

X. filed a request labeled as reconsideration against the Federal Supreme Court’s judgment of 11 April 2011, which had already declared his earlier complaint inadmissible for insufficient reasoning. The Court treated the filing as a revision request, but found that it did not set out any revision ground under Art. 121 ff. BGG. Mere criticism of the prior legal assessment was insufficient. Without a written exchange of briefs, the Court did not enter into the request and waived court costs.

Regeste Omnilex

Art. 121 ff. BGG, Art. 127 BGG; revision of a final Federal Supreme Court judgment requires a statutory ground to be specifically alleged and substantiated. A submission that merely criticizes the legal assessment of the earlier decision is inadmissible as a revision request. In the absence of an arguable revision ground, the court may decline to enter into the request without ordering an exchange of briefs; costs may be waived under Art. 66 Abs. 1 BGG (consid. 1-3).

Staatsanwaltschaft des Kantons Thurgau, Zürcherstrasse 323, 8510 Frauenfeld,
Anklagekammer des Kantons Thurgau, Marktgasse 9, Postfach 339, 9920 Bischofszell.

Gegenstand
Revisionsgesuch gegen das Urteil des Schweizerischen Bundesgerichts 1B_151/2011 vom 11. April 2011.
In Erwägung,
dass das Bundesgericht mit Urteil vom 11. April 2011 mangels einer hinreichenden Begründung im Sinne von Art. 42 Abs. 2 BGG auf eine Beschwerde von X.________ nicht eingetreten ist (1B_151/2011);
dass sich X.________ mit einer als "Wiedererwägungsgesuch" bezeichneten Eingabe vom 12. Mai 2011 ans Bundesgericht gewandt und u.a. das bundesgerichtliche Urteil 1B_151/2011 vom 11. April 2011 kritisiert hat;
dass das Bundesgericht nur im Rahmen eines Revisionsverfahrens auf ein bereits gefälltes Urteil zurückkommen kann;
dass die Eingabe vom 12. Mai 2011 somit als Revisionsgesuch zu behandeln ist;
dass die Aufhebung oder Abänderung eines in Rechtskraft erwachsenen Bundesgerichtsurteils nur bei Vorliegen eines Revisionsgrundes gemäss Art. 121 ff. BGG möglich ist;
dass sich aus der Eingabe vom 12. Mai 2011 nicht ergibt, inwiefern der bundesgerichtliche Nichteintretensentscheid vom 11. April 2011 an einem Revisionsgrund leiden sollte;
dass blosse Kritik an der rechtlichen Würdigung im Revisionsverfahren nicht zu hören ist;
dass ohne Schriftenwechsel (Art. 127 BGG) auf das Revisionsgesuch nicht einzutreten ist;
dass auf eine Kostenauflage verzichtet werden kann (Art. 66 Abs. 1 BGG);
erkennt das Bundesgericht:

1.
Auf das Revisionsgesuch wird nicht eingetreten.

2.
Es werden keine Kosten erhoben.

3.
Dieses Urteil wird den Parteien sowie der Staatsanwaltschaft und der Anklagekammer des Kantons Thurgau schriftlich mitgeteilt.

Question juridique clé

Whether the filing labeled as a reconsideration request had to be treated as a revision request.

Solution extraite

The submission was treated as a revision request because the Federal Supreme Court can reopen a final judgment only through revision.

Motifs extraits

The court stated that it may revisit an already rendered judgment only in revision proceedings.

Question juridique clé

Whether the revision request disclosed any statutory ground for revision of the judgment of 11 April 2011.

Solution extraite

No revision ground was shown.

Motifs extraits

The submission did not explain how the prior non-entry judgment was affected by a ground under Art. 121 ff. BGG; mere criticism of the legal assessment is not admissible in revision.

Question juridique clé

Whether a written exchange of briefs should be ordered in the revision proceedings.

Solution extraite

No exchange of briefs was ordered, and the request was not entered into.

Solution extraite

No costs were imposed.

Motifs extraits

The court exercised its discretion to waive costs under Art. 66(1) BGG.
