Résumé Omnilex

The appellant challenged a cantonal judgment concerning driver's licence withdrawal. The Federal Supreme Court held that the appeal only contained general criticism and failed to explain in a legally sufficient manner why the reasoning or outcome of the lower judgment was unlawful or unconstitutional. Because this defect was manifest, the Court decided the matter in simplified procedure and did not enter into the appeal. Court costs of CHF 500 were imposed on the appellant.

Regeste Omnilex

Art. 42 Abs. 2 and Art. 106 Abs. 2 BGG; appeal inadmissible for insufficient reasoning. A federal appeal must, in a reasoned manner, address the decisive considerations of the challenged decision and show in what respect it violates federal or constitutional law. Mere general criticism does not suffice. If the defect is manifest, the Federal Supreme Court may refuse to enter into the matter in simplified procedure under Art. 108 Abs. 1 BGG. Costs follow the outcome under Art. 66 Abs. 1 BGG.
