The Aargau Department of Construction, Transport and Environment withdrew its appeal against the Federal Administrative Court's decision on the sanitation duty for level crossings at Bibenlos, Berikon and Rudolfstetten. The Federal Supreme Court therefore discontinued the proceedings. It decided to impose no court costs and to award no party compensation.
Art. 66 Abs. 4 and Art. 68 Abs. 3 BGG; withdrawal of an appeal and allocation of costs: where the appellant withdraws the appeal, the Federal Supreme Court shall strike the case from the docket as moot by withdrawal. In such circumstances, the court may waive the levy of judicial costs and deny party compensation, particularly where no further adjudication on the merits is required (consid. 1).

Die Beschwerde im Verfahren 1C_752/2013 wird als durch Rückzug erledigt abgeschrieben.
Es werden keine Gerichtskosten erhoben und keine Parteientschädigungen zugesprochen.
Diese Verfügung wird dem Departement Bau, Verkehr und Umwelt des Kantons Aargau, dem Bundesamt für Verkehr und dem Bundesverwaltungsgericht schriftlich mitgeteilt.
