The Federal Supreme Court declared the spouses’ complaint inadmissible because it did not engage with the cantonal constitutional court’s reasoning and therefore failed the substantiation requirement of Art. 42(2) BGG. The Court applied the simplified non-entry procedure under Art. 108(1)(b) BGG. It waived court costs under Art. 66(1) BGG, which made the request for free legal aid moot. The underlying dispute concerned the refusal of a naturalization request by the Basel civic commune for lack of integration.

If the substantiation requirement is manifestly not met, the Federal Supreme Court may refuse entry under the simplified procedure without examining the merits (consid. 2). Where no costs are imposed pursuant to Art. 66 Abs. 1 BGG, a request for free legal aid becomes moot.

In Erwägung,
dass der Bürgergemeinderat der Stadt Basel am 9. Dezember 2008/ 5. Januar 2009 das Einbürgerungsgesuch der Eheleute X.________ und ihrer sechs Kinder infolge mangelnder Integration abgewiesen hat;
dass das Appellationsgericht des Kantons Basel-Stadt als Verfassungsgericht einen Rekurs der Eheleute X.________ gegen den Entscheid des Bürgergemeinderats mit Urteil vom 5. Oktober 2009 abgewiesen hat;
dass die Eheleute X.________ mit Eingabe vom 1. Februar 2010 eine Beschwerde gegen den Entscheid des Appellationsgerichts als Verfassungsgericht beim Bundesgericht eingereicht haben;
dass nach Art. 42 Abs. 2 BGG in der Begründung einer Beschwerde in gedrängter Form darzulegen ist, inwiefern der angefochtene Entscheid Recht verletzt;
dass sich die Beschwerdeführer mit den Ausführungen des Appellationsgerichts als Verfassungsgericht nicht auseinandersetzen folglich nicht darlegen, inwiefern die Abweisung des Rekurses Recht im Sinne von Art. 42 Abs. 2 BGG verletzen sollte;
dass mangels einer genügenden Begründung im vereinfachten Verfahren nach Art. 108 Abs. 1 lit. b BGG auf die Beschwerde nicht einzutreten ist;
dass auf eine Kostenauflage verzichtet werden kann (Art. 66 Abs. 1 BGG), weshalb das Gesuch um unentgeltliche Rechtspflege sich als gegenstandslos erweist;
erkennt der Präsident:

Auf die Beschwerde wird nicht eingetreten.

Es werden keine Kosten erhoben.
3.
Dieses Urteil wird den Beschwerdeführer, der Bürgergemeinde der Stadt Basel und dem Appellationsgericht des Kantons Basel-Stadt als Verfassungsgericht schriftlich mitgeteilt.
