The Federal Supreme Court held that the appeal against the cantonal decision on a construction permit had become moot because the project had been withdrawn. The case was therefore struck from the roll. Applying the rules on costs in moot cases, the Court considered that the appeal would clearly have been dismissed on the merits and ordered the appellant to pay CHF 1,000 in court costs. No party costs were awarded to the municipality, and the respondent had not sought relief.
Art. 32 al. 2 LTF; mootness of an appeal and cost allocation; when the contested object is withdrawn, the appeal is struck from the roll for lack of current legal interest. For the allocation of judicial costs and party costs, the situation existing before the event terminating the dispute is decisive (Art. 71 LTF in conjunction with Art. 72 PCF by analogy). If the appeal would manifestly have failed on the merits, the costs are borne by the appellant. No party costs are due to a public authority that has not incurred compensable expenses; no costs are awarded to an unrepresented or non-submitting opposing party (cf. consid. 1).

Vu:
L'arrêt du Tribunal cantonal du canton de Vaud (ci-après: le Tribunal cantonal) du 28 avril 2011 déclarant irrecevable le recours de A.________ contre une autorisation de construire délivrée le 26 janvier 2011 à B.________ par la municipalité de Sugnens;
Le recours en matière de droit public du prénommé contre l'arrêt cantonal;
Son courrier du 19 août 2011 avisant le Tribunal fédéral qu'il avait reçu une information de la commune de Montilliez (anciennement Sugnens) selon laquelle le projet mis à l'enquête par B.________ avait été retiré, et estimant que la cause était devenue sans objet;
Les déterminations du Tribunal cantonal, qui considère que le recours paraît conserver son objet;
La réponse de la municipalité de Montilliez, qui fait valoir que le recours, irrecevable et mal fondé, aurait de toute façon dû être rejeté et que les frais et dépens doivent être mis à la charge du recourant;
La réplique du recourant du 20 octobre 2011, par laquelle il maintient sa requête tendant à ce que des dépens lui soient alloués;
considérant:
Que, le projet mis à l'enquête publique par B.________ du 17 décembre 2010 au 17 janvier 2011 ayant été retiré - ce qu'aucune partie ne conteste -, il n'y a clairement plus d'intérêt juridique à statuer sur l'arrêt du Tribunal cantonal du 28 avril 2011, lequel dénie au recourant la qualité pour agir;
Que le présent recours au Tribunal fédéral, devenu sans objet, doit donc être rayé du rôle (art. 32 al. 2 LTF);
Que le sort des frais judiciaires et des dépens doit être décidé en tenant compte de l'état de choses existant avant le fait mettant fin au litige (art. 72 PCF, applicable par analogie en vertu de l'art. 71 LTF);
Que si le recours n'était pas devenu sans objet, il est manifeste qu'il eût été rejeté, l'intéressé habitant à plus de 500 mètres à vol d'oiseau de la parcelle où devait être érigée la construction projetée et n'expliquant pas quels liens particuliers il aurait avec le projet litigieux, ni quel préjudice lui porterait cet ouvrage;
Que les frais judiciaires doivent par conséquent être mis à la charge du recourant;
Que la municipalité n'a pas droit à des dépens (art. 68 al. 3 LTF) et qu'il n'y a pas lieu d'en allouer à l'intimée, qui n'a pas pris de conclusions.
par ces motifs, le Président ordonne:

Le recours 1C_241/2011 est déclaré sans objet et la cause est rayée du rôle.
2.
Les frais judiciaires, fixés à 1'000 fr., sont mis à la charge du recourant.
3.
La présente ordonnance est communiquée aux parties, à la Municipalité de Montilliez (anciennement Sugnens) et au Tribunal cantonal du canton de Vaud, Cour de droit administratif et public.

Whether the federal appeal remained justiciable after withdrawal of the construction project
The appeal had become moot because the contested project had been withdrawn, leaving no legal interest in deciding the cantonal judgment.
Since all parties accepted that the project was withdrawn, there was no longer a legally protected interest in reviewing the cantonal ruling on standing.
Allocation of court costs and party costs after the case became moot
Court costs were charged to the appellant; no party costs were awarded to the municipality or the respondent.
Costs are determined according to the situation before the event terminating the dispute; had the appeal not become moot, it would clearly have been dismissed. The municipality is not entitled to party costs, and the respondent filed no submissions.
