Résumé Omnilex

X. filed an English-language complaint to the Federal Supreme Court against the cantonal judicial authorities of Bern. The Court ordered him to translate the filing into an official language and to submit the challenged decision, warning that the complaint would otherwise be disregarded. He did not comply within the deadline. The Court therefore issued a simplified non-entry decision and waived court costs.

Regeste Omnilex

Art. 42 Abs. 5 and 6 BGG; Art. 108 Abs. 1 BGG: a complaint that is not filed in an official language and is not supplemented within the prescribed period by the challenged decision is not considered. If the appellant fails to cure the formal defects after a judicial invitation, the court may decide in simplified proceedings without further clarification. Court costs may be waived under Art. 66 Abs. 1 BGG.

Question juridique clé

Whether the complaint had to be entered into after the appellant failed to translate it and submit the challenged decision within the set deadline.

Solution extraite

The complaint could not be examined because the appellant did not comply with the formal requirements despite being invited to remedy them.

Motifs extraits

Under Art. 42(5) and (6) BGG, the Court ordered translation into an official language and filing of the challenged decision; the appellant did not respond in time, so further inquiry was unnecessary and non-entry followed under Art. 108(1) BGG.

Question juridique clé

Whether court costs should be charged despite non-entry.

Solution extraite

No costs were levied.

Motifs extraits

The Court expressly waived court costs under Art. 66(1) BGG.
