The Federal Supreme Court’s supervisory commission had requested the Federal Administrative Court to file its archival regulations and supporting explanations concerning docket management and transparency of decision-making. After the respondent submitted the regulation adopted by the full court, including a provision on documenting decision-making, the supervisory concern no longer required further examination. The President therefore struck the proceedings off as moot and ordered that no costs be charged.

Erwägungen:

Die Verwaltungskommission des Bundesgerichts als Aufsichtsbehörde hat das Bundesverwaltungsgericht durch Präsidialverfügung vom 12. Januar 2010 aufgefordert, der Aufsichtsbehörde das Archivierungsreglement samt sachdienlichen Erläuterungen einzureichen.

Die Verwaltungskommission des Bundesverwaltungsgericht hat der Aufsichtsbehörde mit Begleitbrief vom 21. Dezember 2010 das vom Gesamtgericht am 9. Dezember 2010 verabschiedete Aufsichtsreglement fristgerecht eingereicht. Das Reglement regelt die Archivierungsgrundsätze, die Zuständigkeiten und den Zugang zum Archivgut. Es enthält namentlich auch eine Bestimmung über die Dokumentierung der Entscheidfindung (Art. 3 Abs. 1 lit. h). Das Bundesverwaltungsgericht hat damit die Transparenz der Entscheidfindung seiner Verfahren selbst geregelt. Weitere aufsichtsrechtliche Abklärungen erübrigen sich. Das Verfahren kann als gegenstandslos geworden abgeschrieben werden.

Kosten sind im vorliegenden Fall keine zu erheben.

Demnach verfügt der Präsident:

Es werden keine Kosten erhoben.

3.
Dieser Entscheid wird dem Bundesverwaltungsgericht schriftlich mitgeteilt.
