The appellant argued that the cantonal real-estate valuation commission arbitrarily refused to follow departmental instructions fixing agricultural land values. The court held that, regardless of the commission’s institutional subordination, cantonal tax law prevails over administrative instructions. Under the Vaud constitutional rule that taxes may only be instituted by law, instructions must remain within the limits of the law and any conflicting instruction must be set aside. The complaint was therefore rejected.
Art. 19 of the Vaud Constitution; hierarchy of norms in cantonal tax law; administrative instructions cannot override statute. A cantonal tax valuation commission must apply the statutory tax rule even where departmental instructions, issued under delegated competence, provide otherwise. Such instructions are binding only insofar as they remain within the framework of the law and any implementing regulation; if an instruction appears inconsistent with the legal norm, the commission not only may but must depart from it and apply the law. The issue of the commission’s organizational dependence on the Department of Finance is irrelevant to this principle (consid. 2).

C'est en refusant d'appliquer cette règle en l'espèce que la juridiction aurait fait acte d'arbitraire.
Il n'y a pas lieu d'examiner ici si la Commission centrale est soumise au Département des finances ou non. Dans l'un et l'autre cas, elle doit appliquer le droit fiscal cantonal en observant les règles de priorité fixées par la structure du droit public.
La constitution cantonale vaudoise prévoit à son art. 19 que "la loi peut seule instituer les impôts". Tout le droit fiscal doit donc être soumis à la loi, dont le règlement doit observer le cadre pour fixer les modalités d'exécution. Les instructions du Département doivent de même se maintenir dans le cadre du règlement et de la loi. Ainsi c'est avec raison que, au cas où une disposition des instructions du Département des finances lui paraît contraire à la loi, la Commission d'estimation s'en écarte pour appliquer la règle légale.
